Terms and Conditions - International Tours
Deposit
A deposit of $300 is required when confirming a booking. If a deposit is not received by MidEarth Travel within 10 days of confirmation, it is assumed that the customer is no longer interested in the tour package and all reserved arrangements will be released. The booking becomes a contract at the time of deposit payment.
Final Payment
Final payment of the total tour fare is due 30 days prior to departure date. If payment is not received by the due date, the reservation will be subject to cancellation without notice and the deposit will be forfeited. Additional cancellation fees may also be incurred. If booking is made within 30 days of the departure date, full payment is due immediately.
Amendments
A $200 handling fee per change per person applies to any change in itinerary after a booking is confirmed. Once any travel documents and/or tickets are issued, any change of the booking is considered a cancellation. At that point, the cancellation policy applies.
Cancellations
All cancellations must be made in writing (letter or fax). No oral cancellations will be accepted. Cancellation fees will be assessed according to the length of time until departure date: 45 or more days - $200 per person; 30 to 44 days - $400 per person; 14 to 29 days - $500 per person; 4 to 13 days - $1000 per person; less than 3 days or in case of a no-show - 100% of total charges. Furthermore, additional cancellation fees and penalties may be assessed by airlines and/or train operators. MidEarth Travel reserves the right to issue tickets as soon as deposit is received.
Tour Fare Inclusions
Tour fares include hotel accommodation, international and domestic transportation, meals stated, sightseeing, entrance fees stated. Hotel rates are based on double occupancy. Single rooms are available with single supplement fees. Children under 11 may share a room with two adults. MidEarth Travel reserves to substitute hotels in similar or higher class if the hotels advertised are not available. Transportation costs include air, train, and bus transportation within the country of destinations. International air fare from Canada is included in the list price, but may change due to seasonal variability. A travel agent will explain the available air fares at the time of booking. Sightseeing program will be as outlined in tour itinerary. MidEarth Travel reserves the right to amend the itinerary for reasons of weather, labour strikes, natural disasters, war, flight schedule adjustments, safety issues, custom regulations, political circumstances, and others. All stated attraction entrance fees and admissions are included in the tour fare. MidEarth Travel strongly recommends out-of-province health insurance, trip cancellation and interruption, baggage and travel document loss, and flight accident insurance plans.
Tour Fare Exclusions
Tour fares do not include personal charges such as phone bills, laundry, postage, and baggage overweight charges; extended stay fees; tips for tour guides, drivers, and bellmen; visa processing fees and passport application or renewal fees; any other charges caused by acts of God, natural disasters, fires, weather, governmental and local authority orders, political circumstances, labour strikes, war, riots, quarantine, custom regulations, damages or injury caused by accident beyond the responsibilities of travel agents or incurred due to travel actions violating the law; and items not listed in the itinerary.
Special Requests
Special requests regarding dietary requirements, adjoining rooms, double beds, etc. should be noted during the booking process. However, such requests cannot be guaranteed.
Tour Price
All tour prices are in Canadian Dollars and are based on tariff and rates of currency exchange in effect at the time of advertising. These rates are subject to change without prior notice as deemed necessary and fair by MidEarth Travel.
Tour Operator Cancellations
When the total number of tour members should fall below ten persons, MidEarth Travel reserves the right to cancel the tour.
Travel Documents
Travelers may require a passport and visa. It is the responsibility of travelers to ensure that they have the appropriate valid VISA and passport to enter the country concern. All passports must be valid for at least 7 months from departure date for all tour participants. All documents and tickets will be issued under passport name. MidEarth Travel is not responsible when a traveler is denied entrance for any reason by a foreign country, even if the traveler has a valid passport and visa.
Air Transportation
Air transportation for all tours are based on economy class fares. MidEarth Travel endeavors to follow the itineraries precisely; however, if flights are not available at the scheduled time, MidEarth Travel reserves the right to modify the air and land arrangements for smooth operation of the tour. All air fares are subject to change without notice.
Hotels
When an advertised hotel is not available, a hotel of equal or higher class will be substituted.
Baggage Allowance
Baggage is at owner’s risk throughout the tour. For convenience, baggage allowance is suggested to one piece per person each for checked and carry-on baggage. Excess baggage charge and insurance is at owner’s responsibility. For exact baggage allowance policies, please consult your airline.
Children
For children 11 and under, if sharing a bed with either parent and not requesting an additional bed, they will be charged a child's fare. If an additional bed is requested, they will be charged 90% of the adult fare. For children 12 and over, they will be charged at the regular adult price.
Shopping
MidEarth Travel does not take responsibility for any items purchased at shops during the tour. Any after-sales correspondence must be between the traveler and the store themselves.
Responsibility
MidEarth Travel, as tour operator, acts only as an agent for contracted services. All travel arrangements included in this trip are made on participant’s behalf upon the express condition that neither MidEarth Travel nor its agents shall be liable or responsible in the absence of its (or their) negligence for any direct, indirect, consequential, or irregularity of any kind which may be accessioned by reason of any act or omission of any person or entity, including without limitation, any act of negligence or breach of contract of any third party such as an airline, train, motorcoach, private car, cruise vessel, boat, or any other conveyance, hotel, sightseeing provider, local groundhandler, etc., which is to or does supply any goods or services for this trip.
Participant understands that MidEarth Travel neither owns nor operates such third party suppliers and accordingly agrees to seek remedies directly and only with those suppliers and nor hold MidEarth Travel responsible for their acts, omissions or commissions. Without their limiting the foregoing, MidEarth Travel and its agents are not responsible for any losses or expenses due to delay or changes of schedule, over booking of accommodations, default of any third parties, sickness, weather, strike, acts of God, acts of terrorism, force majeure, acts of government’s civil disturbances, war, quarantine, customs regulations, epidemics, criminal activity or for any other cause beyond its control. All such losses or expenses have to be borne and paid for by the participant.
MidEarth Travel accepts no responsibility for value, reliability, quality or authenticity of any goods purchased while on tour or for any mailing, freight or shipping arrangements.
MidEarth Travel reserves the right to substitute hotels, alter the itinerary, withdraw any tour and make any alteration for the convenience of the operation of tours. MidEarth Travel reserves the right to cancel the tour prior to departure for any reason. Liability for such cancellation is limited to full refund of money received by MidEarth Travel, and this will constitute full settlement with the tour member.
All tour fares shown are based on the value of foreign currencies in relation to the Canadian Dollar as of advertising and in current tariffs on the same date and are subject to change. In the destination country, costs are quoted by the local handling travel agency in Canadian Dollars. However, the local handling travel agency reserves the right to alter or adjust its costs. In the event that the local handling travel agency increases the cost of any service within the destination country, tour fares are subject to adjustment. The right is reserved to cancel the tour prior to departure for any reason. In such case, a full refund of all payment will constitute a full settlement with the participant. The local handling travel agency has sole and exclusive control over the operation of all tours in the destination country. The local handling travel agency reserves the right to make alterations or adjustments in the itinerary as to destinations, transportation, accommodations and all other services. Neither MidEarth Travel nor any of its affiliates shall be responsible for any such alteration made by the local handling travel agency.
Baggage is carried at owner’s risk and baggage insurance is recommended. MidEarth Travel is not responsible for typographical or printing errors or omissions in its advertisements. MidEarth Travel accepts no responsibility for cost, which may occur as result of a participant failing to secure adequate insurance coverage, which coverage is highly recommended. Generally, your health insurance does not cover expenses outside Canada. MidEarth Travel is not responsible for participant’s visa or passport requirements, nor will a refund of unused services be made, nor reimbursement of any additional expenditure if a participant is denied entry to a country for this or any other reason.
MidEarth Travel will not be held responsible for loss, death, physical harm or any expenses by passengers if they deviate from original tour itinrary or from tour group.
The general conditions under which you agree to utilize the services of MidEarth Travel may not be amended in any way, except in writing, by an authorized officer of MidEarth Travel. By utilizing the services of MidEarth Travel, you agree that the exclusive venue for all claims shall be the City of Ottawa, Province of Ontario, and such claims shall be determined according to the laws and jurisdiction of the Province of Ontario.
The issuance of tickets and vouchers shall be deemed to be consent to the above conditions and to these terms and conditions.
